The NC Supreme Court's Rosero decision (June 13, 2003) says that there is no longer a common law presumption in NC that mothers of illegitimate children have a superior right to custody based upon NCGS Ch. 50-13.2(a) ("Between the mother and father, whether natural or adoptive, no presumption shall apply as to who will better promote the interest and welfare of the child"). Thus, instead of having to prove these mothers unfit, which was a higher burden, now fathers of illegitimate children (even if they have taken no legal responsibility for their children) only have to prove that it is in the children's best interests to be placed in the father's custody in order to obtain custody. Evidence of the father's lack of parental involvement, failure to pay child support, abandonment, abuse etc. can still be used by the mother to show that the father is unfit or that it's not in the children's best interest to be in the father's custody.
