He was charged and convicted of breach of arrest, behaving himself with contempt or disrespect towards his commanding officer, and conduct prejudicial of good order and military discipline. Capt. Pate sent numerous letters to Gov. Morton requesting his reinstatement. The members of Company C also sent Gov Morton a number of petitions asking for his reinstatement which was finally granted in May 1862.
