Adoption Requirements & Regulations
Thank you for your interest in our program and horses. If you see a horse that interests you and are interested in adopting, please email to FrogPondFarmLTD@aol.com for adoption application. This will need to be completely filled out and either mailed, faxed or e-mailed back to us with a $5.00 processing fee for consideration. Applications will not be processed without fee; we have an account with Paypal to make this transaction easier.
Completing the application is not a guarantee your application will be approved. If at the time you fill out the application and there are no horses available in our adoption program, we will keep your application on file for a period of one year.
Adoption fees are determined by each horse separately. Once adoption application is accepted and a horse is chosen, that horse will not be considered adopted until adoption fee is paid in full. Horses are never held for anyone. Adoption of horses are completed with the first/best person that has everything in place that is required for adoption. Adoption fees will not be returned should you decide at any time you no longer want or can take the horse. Once adoption is complete you have 7 days to arrange shipping and on the 8th day a $10.00 per day board starts and must be paid before the horse leaves the premises.
If you have any questions about soundness or questions about whether a horse will be able to physically do something, have a vet come in to do vet checks. The program gives you all the information that the previous owner (if known) gives us and any additional information we can figure out while the horse is with us and though we think all horses are wonderful, we still can’t guarantee soundness, training levels, or temperment of any adoption horse.
If an adopter requires any special shots, vet checks, or health certificates for their stable or transport, they must be paid for by the adopter and coordinated with Frog Pond Farm before the horse can leave and to make sure they can be done in time for the horse to be picked up by the departing date, we will need to know ASAP. Vet checks vary from $100 to $300 depending on what you have the vet do. Health/shipping certificates are $20. Farm calls are $40 except for Sundays and holidays when they aren’t available. All vet expenses will be paid for prior to being seen by the vet.
Prospective adopters acknowledge and accept that Frog Pond Farm Inc. retains ownership of all adopted horses for a five year period and has the right to check on the progress and condition periodically of every horse. Every June, at the adopters expense, the adopter is required to complete a follow-up form and send photos with satisfactory ratings by a certified vet to Frog Pond Farm, Inc. Until such time no adopted horse is to be sold, lent, leased, given away, sold for slaughter, removed from my personal possession, or moved from the address described herein without FPF’s prior approval and that if proven in violation of any of the above, adopter shall be subject to legal action. If there is a problem any time during the retention period and the adopter no longer wants the horse, or can no longer keep or provide for the horse, then the horse is to be released back to Frog Pond Farm and shipped at adopters expense for re-evaluation and later adopted to another home. Adopter also agrees that an authorized representative of FPF may enter the property where said animal resides to determine if all conditions of this adoption agreement are being complied with. Adopter further offers that should I violate any of these terms an authorized representative of Frog Pond Farm LTD may enter upon the land where said animal resides and take immediate possession of said animal.
Frog Pond Farm LTD has the right to refuse adoption of any horse prior to adoption to any adopter if FPF deems the horse and adopter are not a good match.
Adopter certifies that he/she has no prior violations of adoption regulations or convictions of inhumane treatment to animals. Adopter also allows FPF to check records of local animal control for violations if necessary.
Prospective adopter must understand and accept that once the horse is in their possession all responsibilities and liability in regard to that horse belongs to them.
Upon death of the horse, notification is required immediately with a veterinarian’s statement/cause of death. If the horse suffers a major injury or medical problem, the vet must also report this.
Adopter further agrees to accept all responsibility for any action or lien resulting from any action, directly or indirectly, involving said animal while it is in my care. Therefore, adopter agrees and understands that neither Frog Pond Farm LTD nor any of its employees or agents will be liable for any damages or injury caused to me or any third person by the animal once adopter receives delivery of it, including but not limited to damages or injuries caused by the fact that the animal does not behave or perform in the manner expected. Further, if any third person makes a claim against Frog Pond Farm LTD or any of its employees or agents as a result of conduct of the animal after adopter has taken possession of it, adopter agrees to indemnify and hold FPF , its employees or agents harmless from any such claims, including attorneys fees and costs resulting from such claim. Adopter will be responsible for returning the horse to FPF LTD or will pay all costs involved in their return by an authorized representative of FPF LTD adoption period, if adopter is unable to care for the animal, or if adopter is found in default of any of the conditions of this agreement. In the event of my death during this agreement, adopter directs that funds from estate be used to return the horse herein described to Frog Pond Farm LTD.
All adoption fees go to getting horses, transporting them to the farm, feed, cared for, trained and exercised while here. Frog Pond Farm LTD is currently awaiting its non-profit status recognized by the State of Ohio and Federal Government. We exist solely on the adoption fees and donations to exist. Remember that the money you give today will go to save and care for more horses tomorrow.
This Agreement and the rights and obligations of the parties hereto shall be subject to and shall be construed and interpreted under the laws of the State of Ohio. The parties hereto shall consent to jurisdiction of the courts of Ohio for all purposes and for any disputes arising under this Agreement.
