Floyd, Esquire, Governor of the Commonwealth of Virginia: To All to Whom these Presents shall Come, Greetings: Know Ye, That in conformity with a survey made on the 24th day of January, one thousand eight hundred and forty eight, by virtue of Land Office Treasury Warrant No. 16,226 there is granted by the said Commonwealth unto Washington Hicks a certain Tract or Parcel of Land, containing, fifty acres and laying & being in the County of Braxton on the dividing ridge at the head of Big Spreading Shoal and bounded as follows, Beginning at a whit oak at a low place in the ridge east of Joe? Spring Hole & running N 86 Degree's th 63 poles to 3 chestnut oakes on the waters of Big Laurel Creek & 53 degree's th 36 poles to a chestnut oak N 80 degree's th 20 poles to a forked chestnut oak & 66 degree's th 74 poles crossing over branches of Laurel Creek to a maple & white oak & 50 degree's th 68 poles to 2 white oakes another ? of a field & 26 degree's E. 42 poles to a chestnut and white oak on the said of a ridge N 2 degree's E. 250 poles, crossing branches of, Spreading Shoal Creek to the beginning with it's appurtenances. TO HAVE AND TO HOLD the said Tract or Parcel of Land, with its appurtenances. to the said Washington Hicks and His heirs forever. IN WITNESS WHEREOF, The Said, John B. Floyd, esquire, Governor of the Commonwealth of Virginia, hath hereunto set his hand and caused the Lesser Seal of the said Commonwealth to be affixed, at Richmond, on the 31st day of January in the year of our Lord, one thousand eight hundred and forty nine and of the Commomwealth the 73. Washington Hicks lived on this grant with both of his wives and died there. In 1858 Clay County was formed from Braxton & Nicholas and part of the land became Clay County - In 1856 Calhoun was formed. A twist of fate would bring the Governor who signed the Land Grant John. B. Floyd into Nicholas County during the Civil War. John B. Floyd was the General in charge of the Confederate forces at the Battle of Carnifex Ferry, Nicholas County Va./W.Va., against Union General William S. Rosecrans The Battle took place September 10, 1861 from 3 to 7 p.m. on the Henry Patterson Farm Grant District, Nicholas county, 2 1/2 miles from Keslers Cross Lanes. Darkness had fallen by the time General Rosecrans had a massive storming invasion force ready. Floyd failing to receive requested reinforcements from General Wise, during the darkness of night Floyd moved his whole army down the steep mountain cliffs of Gauley crossed the river and retreated to Sewell Mountain without the Union army never knowing a thing. This remains one of the greatest feats of the Civil War. Washington Hicks's, 5th child Joseph Hicks was on a farm nearby and could recall as a child the long colums of soldiers marching by. He was raised by George Brown and during the Civil War George would send him and a nephew Anothony Mack ( Grandpa Cody called him Uncle Mack) Keenan to hide the live stock from both armies.

---The Last will and Testement of George W. Hicks of the Distict of Washington, in the County of Calhoun and State of West Virginia, Made and published this sixth day of June in the year of our Lord, One thousand Eight hundred and ninety seven. -----------In the name of God Amen. I George W. Hicks of the District of Washington, County of Calhoun, State of West Virginia of the age of seventy three years and being of sound mind and memory, do hereby Make, Publish and declare this my last will and testement in manner following, That is to say. First it is my will that my funeral expenses and all my just debts be freely paid. Second, I give and bequeath to my wife Elizabeth Hicks Ninety- Eight acres and one half acres of land 98 1/2. known and described as follows. bouded on the North by J.H. Moss, on the East by J. O. Watson, on the South by M.J. Metz, and on the West by P. Hays, Land---Third, I also bequeath to my wife Elizabeth Hicks. Thirty(30)Head of Sheep, Two Sorrel Horses, 3 head of Cows, one calf true, 10 Head of Hogs, one road wagon, one saddle, 2 pair of Geese, also my household goods. My wife Elizabeth Hicks shall have the use of my homestead farm of Ninety eight and one half 98 1/2 acres and all other property, personal and real left after the above provisions of my will are satisfied, and of the benefits and procedes of all the stock gave and other produce or personal property which may bethere at my death, all the grain, chattles or other personal property upon said Estate not otherwise provided for shall be excedes her full controle and devoted soley to her own use and disposition. --- Lastly I hereby nominate and appoint John N, Vincent to be the Executor of this my last will and Testament hereby revoking all former wills by me made. In witness whereof i have hereunto set my hand and Seal the 26th day of June In the Year of our Lord, one thousand Eight Hundred and ninety Seven 1897. -- Signed George W. Hicks

Page 83 - The above instrument Consisting of one that was made here subscribed by George W. Hicks the testator we the presents of each of us and was at the same time declared by him to be his last will and testement and we at his request sign our names, hereto in his presence as attesting Witnesses. Signed J. N. Vincent, Minnora Mg., H.C.Lamb (?) ----------West Virginia To Wit.(Hard to make out this word) of the County Court of Calhoun County, in the clerks office of said County, at the Courthouse thereof, on Monday the 11th day of 1897. A paper writing purpoting to be the last will and testement of George W. Hicks, desceased who had a known place of residence in the County of Calhoun, where in he died, was this day presented to the undersigned clerk of the County Court at the Clerks office of the said County by J. N. Vincent and H. C. Lamb (?) the subscribing witnesses with whom the said was left by the testator for safe keeping and thereof on cause J. N. Vincent and H. C. Lamb (?) the subscribing witnesses to said writing and after being duly sworn say that at the time of the execution of said writing. The said George W. Hickswas of sound mind and disposing memory and was over the age of 21 years, that he signed the said writing in their presence and published and declared the same. as and for his last will and testament and that they at the same time, at the request of the testator and in his presence, and in the presence of each other subscribed the said writing as witnesses.
