Dear Governor McGreevey,
I am writing/faxing this letter in support of Elizabeth F Shea's request for both a meeting with you, and an investigation into the denial of her accidental retirement pension.
Two NJ Supreme Court Justices believed the following:
1) An accidental encounter, BY STUDENTS, should be considered a " traumatic
event."
2) A principal should not ignore safety/medical procedures & physically move
a teacher,over her screaming protests.THUS BEING CONSIDERED A
TRAUMATIC CONTRIBUTORY FACTOR to accidental pension. Principal's
actions should not be excused/negated as simply "going to her aid."
3) Testimony given while under the influence of a severe narcotic, should be
re-examined.
4) ENTIRE evidence should be considered:Both verbal AND physical
demonstration(s) should be considered.
5) Orthopedic surgeons' reports should be considered.
6) 12 hours of surgery should be considered as well as cervical brace/cane.
I do not believe that the Teacher's Pension & Annuity Board considered
the full physical or medical evidence in their denial of Shea's accidental pension.
I believe that their decision was both arbitrary and in conflict with previous
decisions.
It would be greatly appreciated if Elizabeth Shea's request(s) for both a personal meeting with the governor, as well as an investigation into this matter be granted.
