A violation of Article 17.3 normally occurs if the USPS does not provide information requested by the Union or they fail to give the Union the time the Union requests to investigate a grievance or if they try to transfer or excess a Union Steward from that Steward’s work section and tour without first removing all other employees from the tour and section.

Article 17.4 is violated when the USPS fails to pay a Union steward for all time associated with processing a grievance whether it be on or off postal property as long as the case the steward is working on is associated with an issue at that steward’s home office. If a steward is processing a grievance relevant to an issue unassociated with his / her home office, then the Union should pay that steward’s time, if provisions for such pay are available.

Article 17.6 is violated when the USPS does not afford the Union the time the Union claims they need to do an employee orientation which is required by federal law. The orientation KYOWVA uses as linked on our main page takes about 2 hours to present normally, provided more questions than normal are asked by the new employee(s) being given orientation. There are many things to cover and it is not unreasonable to take this two hours.

Article 17.8 is violated when the Union is not given access to a phone(s) at a postal facility to conduct any type Union Business.

Article 17.9 is violated when the employer does not give the Union an opportunity to be present when the USPS is doing an inspection of an employee’s locker, except in a crime situation or if the employee has been given at least a weeks notice prior to the inspection.
