ARTICLE 9
A violation of article 9 occurs anytime the USPS fails to pay you consistent with any pay provisions found in the article. Further, violation of this nature relevant to pay in this article may be filed on up to 6 years from the violation pursuant to the Back Pay Act.
Note: Alleged overtime violation issues are not covered by the Back Pay Act normally and these type grievances must be filed within 14 days from the date the grievant becomes reasonable aware of the alleged overtime violation.
The grievant normally does not become aware until after they have received their pay check and find out overtime was not paid for such violation.
One angle to use here if the individual grievant is past the 14 days time limits for filing, is to file the grievance as a Union grievance and then the 14 days does not start until the USPS can prove the Union knew of the alleged overtime violation.
