This agreement is meant to accommodate both the scriptwriter and The Script Genie.
Please fill this out and keep one copy for yourself and mail one copy to me with your script. This is a standard professional agreement. If you have any questions or concerns, please do not hesitate to e-mail me at heavann@aol.com
Submission Release of Claims Form
I hereby grant the service of The Script Genie and its affiliates the right to read and evaluate the accompanying screenplay material (The Submission), entitled: _____________________. I acknowledge that the submission was written by Releaser(s), ________________(referred to herein as, “the Writer(s)”.The Writer(s) also acknowledge that the Writer(s) hold(s) all legal rights to the material and has not knowingly infringed on anyone's copyright or trademarks.
The Writer(s) understand(s) that The Script Genie and its affiliates are exposed to many stories, concepts, premises, ideas and other literary materials, via this service and through other means.
The Writer(s) will not be entitled to any compensation or other consideration because of the use of such similar or identical material, stories, concept, premises and/or
ideas that may have been received by The Script Genie and its affiliates.
The Writer(s) hereby release, discharge forever The Script Genie and its affiliates from any and all claims, liabilities actions, causes of action, demands, suits in law and equity, known or unknown, arising from the date signed on this agreement and release, respect or related to, the literary evaluation, suggestions and coverage services of The Script Genie and its affiliates .
The Writer(s) acknowledge(s) that it is their responsibility to copyright or register the submission prior to submitting it to The Script Genie and hereby release The Script Genie and its affiliates from any claims that arise from the Writer’s/Writers’ failure to do so.
The Writer(s) also understand(s) that The Script Genie and its affiliates are under no obligation other than to provide evaluation of the literature submitted and suggestions for improvement("Coverage").
The Writer(s) understand(s) that evaluation of the literature submitted to Script Genie and its affiliates as well as suggestions for improvement("Coverage") are a subjective process, allowing for reasonable disagreement as to the relative merits of the submission and that comments on the writer's/writers’ project may not be favorable. Script Genie and its affiliates cannot be held liable for any unfavorable comments made in such ordered coverage and that that the evaluation fee is non-refundable.
The writer(s) has/have retained a copy of the enclosed script. The writer(s) agree(s) that Script Genie and its affiliates cannot be held responsible for lost or damaged scripts.
It is further stipulated that this Release shall be binding upon both parties, their representatives, successors, executors and assigns.
