PROPERTY RIGHTS, RESPONSIBILITIES LIABILITY 2.1 DELEGATION OF USE Any owner may delegate, in accordance with the Bylaws, and Covenants, Conditions and Restrictions the right of enjoyment to the Common Area and facilities to members of his family, his tenants, or contract purchasers who reside on the property 2.2 VISITING CHILDREN Visiting children must be under supervision while in the Village. 2.3 LIABILITY The home and all personal property of each owner and his tenants or guests are at the risk of the owner. The owner agrees that the Association and its property manager shall not be liable for or on account of, any loss or damage sustained by action of any third party, fire, theft, water, or the elements or any act of God, or for loss or any property from any cause. The Association and property manager shall not be liable for any injury to the owners, his family, tenants or guests occurring in the Village unless caused by the Association, its property manager or their representatives in the maintenance of the Village. The convenience of the owners and their use by owners and their tenants or guest are at their own risk. 2.4 OWNERS INSURANCE By virtue of taking title to a Lot subject to the terms of this Declaration, each Owner covenants and agrees with all other Owners and with the Association that he shall carry an individual homeowner’s policy. Each individual Owner further covenants and agrees that in the event of a partial loss of damage and destruction, resulting in less than total destruction, the individual unit Owner shall proceed promptly to repair or reconstruct the damaged structure in a manner consistent with the original construction. In the event that the structure is totally destroyed and the individual Owner determines not to rebuild or to reconstruct, the individual Owner shall clear the Lot of all debris and return t to substantially the natural state in which it existed prior to the beginning of construction. 2.5 ANIMALS No animal, livestock, or poultry of any kind shall be raised, bred, or kept on any lot, except that cats, dogs, birds, or other household pets may be kept if they are not kept, bred, or maintained for nay commercial purpose and that they shall not be kept in number or under conditions reasonably objectionable in residential community. 2.6 BUSINESS AND COMMERCIAL USE OF PROPERTY PROHIBITED No trade, craft, business, profession, commercial activity, other than home business, shall be conducted or carried on upon an residential lot, or within any building located on a residential lot. No goods, equipment, vehicles (including buses, trucks, and trailers of any description) or material or supplies used in connection with any trade, service or business, wherever the same may be conducted, or any vehicle in excess of 10,000 pounds gross weight (including buses, trucks and trailers of any description) regardless of the purpose for which such are used, may be kept on any street within the property except for those necessary for initial construction. Nothing shall be done on any residential lot which may be or may become an annoyance or nuisance to the neighborhood. 2.7 PETS 2.7.1 GENERAL Pets must be kept on leash and never allowed to RUN AT LARGE, be a nuisance to others OR CREATE A HEALTH HAZARD WITHIN THE VILLAGE. 2.7.2 ODORS AND DROPPINGS Pets must be aired on owner’s lot or off Village property. All “droppings” must be promptly disposed of by the owners. 2.8 REFUSE No lot or tract shall be used as a dump for trash or rubbish of any kind. All garbage and other waste shall be kept in appropriate sanitary containers for proper disposal. Yard rakings, such as rocks, lawn and shrubbery clipping, and dirt and other materials shall be the sole responsibility of the individual lot owner. All incinerators or other equipment for the storage or disposal of trash, garbage or other work shall be kept in a clean and sanitary condition. Each homesite will have a garbage can(s) of a type and material and/or size as recommended by the disposal service with a tight fitting lid(s). The resident is responsible for his/her own garbage disposal. Every resident has a responsibility to help keep the community clean and neat.
