ARCHITECTURAL CONTROLS

6.1  ARCHITECTURAL CONTROL

No building, fence or wall shall be erected, placed or altered on any lot until the construction plans and specifications and a plan showing the location of the structure have been approved by the Architectural Control Committee as to quality of workmanship and material, harmony of external design and color with the existing structures and as to location with respect to topography, vegetation and finish grade elevation.

6.2 ARCHITECTURAL CONTROL COMMITTEE

The Architectural Control Committee is composed of the developer until 100% of the Lots are occupied.  At that time three (3) homeowners will be selected by the Board of Directors to serve on the Committee.  A majority of the committee may designate a representative to act for it.  In the event of death or resignation of any member of the committee, the remaining members, shall have full authority to designate a successor.  Neither the members of the committee nor its designated representative shall be entitled to any compensation for services performed pursuant to this covenant.  At any time, the then record owners of a majority of the lots shall have the power through membership of the committee or to withdraw from the committee or restore any of its power or duties.

6.3 ARCHITECTURAL CONTROL PROCEDURE

The Committee’s approval or disapproval as required in these covenants shall be in writing.  In the event the committee or its designated representative fails to approve or disapprove within thirty (30) days any plans and specifications which have been submitted to it, or in any event, if no suit to enjoin the constructions has been commenced prior to the completion there of, approval will not be required and the related covenants shall be deemed to have been fully complied with.

6.4 ARCHTITECTURAL CONTROL GUIDELINES

6.4.1 ADDITIONS

Cabanas, screened in additions, porches and patios must be built in compliance with local building codes and approved, in advance by the Architectural Control Committee.

6.4.2  ADDRESS

Visible house numbers with light post are required for each home.

6.4.3  BUILDING PERMITS

Building permits are required by Kitsap County Building Department prior to set up of the home and the prevailing building codes must be followed.

6.4.4  CARPORT/GARAGES/SHEDS

Carports, garages, or sheds must be completed within sixty (60) days of start of constructions of “home set up” subject to approval of the Architectural Control Committee.

6.4.5 DATE FOR COMPLETION OF CONSTRUCTION

Any dwelling or structure erected or placed on any residential lot shall be completed as to external appearance, including finished painting, within sixty (60) days from date of commencement of construction.

6.4.6 DRIVEWAYS, STEPS AND WALKS

All driveways, steps and walks to fron entrance of home must be concrete.

6.4.7 DWELLING SETUP

All foundation work and blocking shall be done by a certified licensed contractor to county and manufacturers specifications.

6.4.8 DWELLING SIZE AND LOCATION

The ground floor area of the main structure, exclusive of open porches and garages, shall be not less than 700 square feet.  In any event, no building, including porches, roofs, overhangs and steps, shall be located on any lot nearer than ten (10) feet to the front property line, nearer than ten (10 feet to any side street line, or nearer than fifteen (15) feet to the rear lot line.  For purpose of this covenant, eaves, steps and open porches shall not be considered as part of the building provided, however, that this shall not be constructed to per permit any portion of a building on a lot to encroach upon another lot.

6.4.9 FENCING AND SCREEING

Fence and screening design and location are subject ot approval by the Architectural Control Committee.

6.4.10 GRADING

Each home shall be set up with lot grading to confrom with the overall grading plan of WINCHESTER VILLAGE.

6.4.11 GUTTERS AND DOWNSPOUTS

All homes shall have county approved gutters and downspouts.  Downspouts shall have splash pads with water directed as per overall grading plan.

6.4.12 LANDSCAPING

The front yard of each homesite shall be landscaped within thirty (30) days of set-up.  Residents shall maintain their site with green plants, flowers, bark, gravel, rock, driftwood, or other landscaping as is commonly used in the Pacific Northwest and approved by the Architectural Control Committee.

6.4.13 MANUFACTURED HOME STANDARDS

All homes are to be built to meet the HUD Manufactured Home Standards and shall meet all county codes for installation and set-up.

6.4.14 POWER

The owner is responsible for the power connection from the pedestal to the meter base on the home.  A county or state permit is required.

6.4.15 SIDING

All homes must have residential or lap siding.

6.4.16 WATER

The owner is responsible for all water charges by ANNAPOLIS WATER DISTRICT.

6.4.17 YARD LIGHTS

Each home site shall be equipped with a front yard light located on the address post.  It is intended to supplement the street lights.  Each resident is responsible for the maintenance of their own yard light.
