ARTICLE I.
DEFINITIONS
1.1 ASSOCIATION
"Association" shall mean and refer
to WINCHESTER VILLAGE HOMEOWNERS ASSOCIATION, a Washington non-profit corporation,
its successors and assigns.
1.2 CLOSED
"Closed" shall mean and refer to the
completion and recording of the sale of a lot to an individual(s) or corporation.
1.3 COMMON AREA
"Common Area" shall mean all real
property, capital and improvements thereon owned by the Association for
the common use and enjoyment of the owners. The Common Area to be owned
by the Association at the time of the conveyance of the first lot is described
on Exhibit "B".
1.4 DECLARANT
"Declarant" shall mean and refer to
CONVERSE PARK JOINT VENTURE a Joint Venture consisting of Trimen Development,
Inc., its successors and assigns; provided, however, that no successor
or assignee of Declarant shall have any rights or obligations of Decarant
hereunder unless such rights and obligations are specifically set forth
in the instrument of succession on assignment.
1.5 DWELLING UNIT
"Dwelling unit" or "unit" means any
portion of a building situated on the properties, which portion is designed
and intended for use and occupancy as a residence by a single family.
1.6 FORECLOSSURE
"Foreclosure" shall mean and include
a notice and sale proceeding pursuant to a deed of trust or sale on default
under a security agreement or
A sale of mortgaged property to obtain
satisfaction of the mortgage or other debt secured by the property, whether
authorized by decree of the court or by a power of sale contained in the
mortgage or other security instrument.
1.7 INSTITUTIONAL LENDER
"Institutional Lender" shall mean
and refer to a mortgagee which is a band or savings and loan association
or established mortgage company, or other entity chartered under federal
or state laws, any corporation or insurance company, or any federal or
state agency.
1.8 LOT
"Lot" shall mean and refer to any
plot of land shown upon any recorded subdivision map of the Properties
with the exception of the common area.
1.9 MANAGEMENT
"Management" shall mean and refer
to any designated representative the Home Owners Association appoints to
manage the Village Properties.
1.10 MORTGAGE
"Mortgage" shall mean and include
any deed of trust or other security instrument.
1.11 MORTGAGEE
“Mortgagee” shall mean and include
the beneficiary of any deed of trust, a secured party, or other holder
of a security interest.
1.12
OCCUPIED
“Occupied” shall mean and refer to
any lot which has a dwelling unit situated on it.
1.13
OWNER
“Owner” shall mean and refer to the
record owner, whether one or more persons or entities, of a fee simple
title to any lot which is a part of the properties, including contract
sellers, but excluding those having such interest merely as security for
the performance of an obligation.
1.14
PERMANENT RESIDENT
“Permanent Resident” shall mean and
refer to any person residing in any dwelling unit for a continuous period
of sixty (60) days or more.
1.15 PROPERTIES
“Properties” shall mean and refer
to that certain real property owner by the Winchester Village Home Owner’s
Association and Coverse Park Joint Venture and legally described on Exhibits
“A” and “B”.
1.16 TENANT
“Tenant” shall mean and refer to any
person renting or leasing a lot from the owner of the lot.
1.17 VILLAGE
“Village” shall refer to and mean all
the property within boundaries as shown on the final plat map, including
lots and tracts.
